Rental Agreement – Game Rental Service

This Rental Agreement ("Agreement") is made and entered into between:

Lessor and Lessee (the customer)

1. Subject of the Agreement

The Lessor agrees to rent out the following game package ("Rented Item")

2. Rental Period

The rental period begins on the date of dispatch and ends on the agreed return date. The Rented Item must be returned no later than six (6) working days after dispatch. Saturdays are considered working days.

3. Security Deposit

The Lessee shall pay a refundable security deposit of 75€ prior to dispatch. The Lessor may retain all or part of the deposit to cover damages, loss, or non-return of the Rented Item. The retention of the deposit does not release the Lessee from the obligation to return the Rented Item.

4. Return of the Rented Item

The Rented Item must be returned in its original, undamaged condition, including all accessories, packaging, and components. In the event of damage, tampering (e.g., removal of items, altered lock codes, etc.), or incomplete return, the Lessor reserves the right to deduct an appropriate amount from the deposit at their discretion, without being required to provide a breakdown of individual costs.

5. Contractual Penalty for Non-Return

Should the Lessee fail to return the Rented Item within seven (7) calendar days after the agreed return date, a contractual penalty of 25€ per day shall become due. This does not affect the Lessor's right to claim additional compensation or initiate legal proceedings.

6. Shipping and Delivery

The Rented Item will be dispatched on the next working day after payment is received. Standard delivery times are typically within two (2) working days. The Lessor shall not be held liable for delays in delivery caused by third parties.

7. Liability and Safety

The Lessee bears full responsibility for the safe handling of the Rented Item and its components.

The Lessor shall not be held liable for personal injury or property damage arising from the use of the Rented Item or its contents. Improper handling of substances, electronic parts, or chemicals is strictly prohibited.

The Lessee must follow all in-game instructions (e.g., "do not open," "for emergency only," etc.). No item may be ingested or come into contact with eyes or mucous membranes. Appropriate safety measures (e.g., use of goggles, storage out of reach of children or pets) are the responsibility of the Lessee.

8. Governing Law and Jurisdiction This Agreement shall be governed by and construed in accordance with the laws of Rhineland-Palatinate. The place of jurisdiction for all disputes arising from or in connection with this Agreement shall be Kaiserslautern.

9. Severability Clause

Should any provision of this Agreement be or become invalid, the validity of the remaining provisions shall not be affected. The parties shall replace the invalid provision with one that most closely reflects the original intent.
